I feel ripped off from a an EV enthusiast in the US (Jerry Dycus) who has promised
to return my money back for services and goods not delivered. This was for 3 Contact Controllers and after almost a year of empty promises and a long period of no response Im left with no choice but to write this and follow a legal course of action. I sent funds to cover the parts to build 3 Contact controllers that would work with 12 x 6v T105 type batteries. (I wanted the extra controllers to hopefully run a second low power EV, to have a spare for parts and to make it a worthwhile exercise since no one else was apparently interested) I sent funds and a little extra to cover any paypal fees into his friends paypal account as Jerry no longer had one and it would be the easiest way for the transaction. He also suggested I send the funds before the economy got worse than it already was as my Australian dollars were going to go further south than they already sat. After the money was sent Ive received some emails suggesting what I should do to run his reliable and simple CC and also an email to tell me a CC was almost ready but was awaiting a correct part. Since then my emails have gone un-answered for halve a year until I wrote one explaining I am considering legal action. Only then did he reply saying he will re-imburse me and asked for my paypal account. His true and tried CControllers have supposedly failed his testing and due to the financial downturn wasnt able even send a picture of what he has supposedly built, or even at least keep me aware of what was happening. Now I feel Ive been cheated by empty promises on something this person is supposed to have considerable experience in and was supposed to be made using his true and tried designs. I didnt want to reach this point and write this, however enough is enough after promising to send part payments through my paypal account yed again nothing. Initially I felt since this person has dealt with respected and helpful individuals, I should trust dealing with him. After almost a Year this is the start of my proceedings to receive what is owed to me. Very upset start to my EV projects and efforts. Any suggestions? Edited by AMPrentice - 27 July 2009 at 9:52am |

did you use a credit card via paypal?
If so, just use the consumer protection on your credit card. not sure if you can use paypals consumer protection on a straight money transfer. Matt |

If money transfer was for goods then paypal will take up the case on your behalf. They recovered funds for me on a $400 purchase that went wrong. But.... there are time limits imposed by paypal. You need to log into your account and fill out the dispute form. Keep all your correspondence as paypal will require it.
Worth a try, although it may have gone too long. Best is to lodge a dispute early if things are not working out even if you don't end up using it. (I've done so on a few deals) Visa card may also help but if funds were paid to paypal for a transfer then it is possibly out of their hands. Can you post details of the seller. Someone may have contacts in the area. |

Go on to DIYelectric car and possibly see if anyone can follow up more from the US end.
Paypal has a time limit (i got stung on this once)and its not that long. If you order anything large from europe that comes via sea it almost reaches the time limit sometimes. Good luck, sorry to hear it went bad on you :(. |

The issue that annoys me the most is the empty promises and the lack of response. He halve built the Freedom Car or EWoody. http://www.evalbum.com/168.html I was after a contactor controller of his supposedly proven design and was even told it was almost finished ready for shipping. That was almost 9 months ago unfortunately and it saddens me that Ive held on hoping he could deliver. jerryd wrote **It'll take me 2 months plus shipping to make, set up the tooling and get it to you. ** Edited by AMPrentice - 27 July 2009 at 8:02pm |
